All products and services provided by Eponine Patisserie Ltd are subject to the following terms and conditions.
By accessing this website or placing any order through any medium, you are agreeing to abide by these terms and conditions.
Eponine Patisserie Ltd reserve the right to change or amend these terms and conditions at any time without notice.


Online Shop

All prices, ingredients, products and availability are subject to change without notice.

For more information on Shipping and Returning items, please see our Delivery & Returns policies which form part of these terms and conditions.

All delivery timescales are in business days and are given as a guide only.

Prices displayed in the online shop are inclusive of any applicable taxes and are exclusive of delivery.

After placing an order through our online shop, a confirmation of your order details will be sent via email to the address you provided. This will include your name, billing and shipping addresses, payment method, email address, telephone number, items ordered, and your unique order number. If any of this data is incorrect, or you do not receive this email within 5 working days, please contact us. This email does not constitute a formal acceptance of your order, or formation of a contract between you and Eponine Patisserie Ltd. Acceptance of your order and formation of a contract shall only occur upon successful credit or debit card authorisation, completed payment, and dispatch of goods. Eponine Patisserie Ltd reserves the right to decline your order for any reason, including but not limited to shortages or unavailability of stock, and inability to authorise payment.

Payment for online orders must be made by debit card, credit card or PayPal. We do not accept any other payment methods for online orders at this time.

Authority for payment will be requested from your card issuer or PayPal at the time of ordering. We reserve the right to terminate any agreement with you if payment is refused at any stage.

It is your responsibility to check the condition of all products and alert us to any damaged or faulty items immediately upon receipt. Please send photographs of any damage or faults to our email address (contact@eponine.co.uk), including images of the item, the item’s box with the Best Before date visible, and the postal packaging it has arrived in. Under no circumstances shall we be held liable for any complaints or issues which are not reported within 24 hours of delivery.


Products

Product images are provided for illustrative purposes only. Our products are handmade and contain natural ingredients, therefore actual products may vary (including packaging).

All our products are made in an environment where known allergens are used (including but not limited to peanuts, nuts, gluten, milk, eggs, lupin and soya).

Weights, sizes and dimensions given are approximate and may vary slightly due to the handmade nature of our products.

Some products may contain non-edible items such as packaging, bases, structural supports or decorations. It is your responsibility to remove these as appropriate before serving.

Number of servings for multi-portion items are approximate and dependent on correct portioning. We cannot be held responsible for any shortfalls in portions.

As taste is a subjective matter, we cannot accept the return of any non-faulty product because you do not enjoy the flavour.

Items should be consumed by their best before date. Many products will still be safe to consume beyond this date but may suffer deterioration in flavour and quality for which Eponine Patisserie Ltd. cannot be held responsible.

Any shelf life given in product descriptions on the Eponine Patisserie Ltd. website, catalogues, etc. is for indication purposes only and is not a guarantee. Our products contain fresh ingredients which will affect the best before date of each batch. If you require a product to last a certain amount of time and/or beyond a specific date, please discuss this with us before purchasing.


Delivery of Online Orders

Please see our Delivery Information page for more information regarding our delivery options and policies.

Where multiple shipping conditions are present (e.g. a back-order item for Christmas Delivery), the latest shipping date will take precedence.

Delivery is out of our control once the order has been dispatched. Transit times may be longer during busy periods (e.g. Christmas), adverse weather conditions or industrial action which affects the courier.

Please ensure that all information is correct during checkout as we will post to the delivery address exactly as provided on our website checkout page. It is your responsibility to ensure that this address is correct and that all details are accurate. We do not check or verify addresses, and accept no liability (financially or otherwise) for orders which are not received due to the provision of incorrect delivery details.

The price of delivery will be calculated and displayed at checkout and is not included in the price of goods displayed in the online shop.

Our items will not fit through a letterbox as they are sent as parcels. Someone will need to be available to accept the parcel when it is delivered. It is your responsibility to ensure that an appropriate person is available to receive the order at the delivery address at the time of delivery.

If no-one is available to receive the order, the courier may attempt to leave the goods in a safe place or with a neighbour. This is at the discretion of the courier, and Eponine Patisserie Ltd. cannot be held liable for any loss or damages which occur after delivery has been made. Alternatively, the parcel may be held at a local post office or delivery depot, in which case it is your responsibility to arrange re-delivery or collection of the parcel with the courier.

Should you fail to be present to receive your delivery and/or arrange re-delivery or collection, we reserve the right to charge you for the full amount for any goods and for the cost of delivery. Eponine Patisserie Ltd. cannot be held responsible for any issues arising from a failed delivery attempt, including but not limited to missing a specified delivery date or occasion and shortfalls in shelf life.

If a parcel is returned to us following a legitimate but unsuccessful delivery attempt, we may offer to ship the parcel a second time. Any offer to ship returned parcels is at the discretion of Eponine Patisserie Ltd. and may be charged at the appropriate shipping rate. Returned items which are no longer within their use by date will be destroyed and no refund will be offered.


Large or Custom Orders including Corporate and Wholesale

Orders can be placed through consultation by phone or email.

We do not offer credit unless otherwise agreed. Any lines of credit offered will be at the discretion of Eponine Patisserie Ltd. Late payments may attract debt recovery costs and statutory interest.

Samples may be made available upon request and are chargeable at standard retail price. Custom samples may be offered at the discretion of Eponine Patisserie Ltd., and will be charged at the cost of labour and materials. Please discuss your sample requirements during consultation.

Quotations are valid for 14 days unless otherwise stated.

Any changes made to orders/bookings, including delivery/collection dates, are subject to availability and may require re-quotation. Changes made after an order/booking has been confirmed may result in additional fees and/or terms, which will be outlined in a re-quotation. Withholding payment of any additional fees or failure to communicate within the time specified on the re-quotation will be considered a cancellation of the order/booking by the customer.

Cancellation of an order/booking by the customer will result in any prior payments made being forfeit.

All products remain the property of Eponine Patisserie Ltd. until paid for in full.

It is your responsibility to ensure that you are able to receive and read emails or other communications relating to your order at all times. We cannot be held liable in the event that communications regarding an order or payments are missed for any reason. Not responding to these emails in a timely manner may result in order cancellation and the forfeit of any monies paid.

Please state any specific dietary requirements when ordering and ensure that they have been included in the quotation when confirming your order.

Eponine Patisserie Ltd. takes no responsibility for products once they have been collected/delivered.

All products are subject to availability. In the unlikely event that any goods are unavailable, we will attempt to contact you and may offer a reasonable substitute.

Eponine Patisserie Ltd. reserves the right to create and retain images of any product for advertising or any other purpose. These images remain the intellectual property of Eponine Patisserie Ltd.

It is your responsibility to ensure that someone is available to accept delivery of the goods and that appropriate parking and access is provided. Eponine Patisserie Ltd. takes no responsibility for deliveries which cannot be made due to nobody being available at the delivery address, or the address being inaccessible, and reserves the right to charge the client for any additional delivery fees or charges incurred as a result.

Goods must be inspected immediately at the time of delivery/collection. Any problems, discrepancies or damaged goods must be reported to Eponine Patisserie Ltd. within 24 hours of receipt in order to claim credit, replacement or reimbursement. Under no circumstances shall we be held liable for any issues which are not reported within 24 hours of delivery.

Orders collected from or delivered directly by Eponine Patisserie Ltd. must be checked and signed for upon receipt. Eponine Patisserie Ltd. cannot be held responsible for any damages, discrepancies or errors which are not reported before the order has been signed for. A third party may sign for receipt of goods, in which case they accept all responsibility for checking the order is correct and the safekeeping of the items after delivery.

Goods may be made available on a works only basis to be collected by the client or their preferred agent. These goods must be checked and signed for at the time of collection. Eponine Patisserie Ltd. takes no responsibility for goods once they have left the premises.

For orders to be collected, it is your responsibility to ensure that you or your appointed agent collect on the agreed date. If the goods are not collected, we will attempt to contact you to arrange alternative delivery or collection. Goods may be held subject to a storage fee. We accept no responsibility for goods being stored beyond the agreed collection date. Failure to re-arrange collection/delivery or refusal to pay incurred fees will be considered a cancellation of the order by the client.

Stock of moulds, ingredients, packaging, etc. purchased by and held on behalf of a client for the purpose of fulfilling their orders remains the property and responsibility of the client. This stock will be returned to the client at the end of agreed works or upon request. Stock will not be held for longer than 2 months from the date of the previous invoice without prior agreement, at which time it will be returned to the client or disposed of. The client takes full responsibility for any costs, handling fees or delivery charges incurred during holding or return of stock. Held ingredients which go out of date and items which are damaged/worn will be disposed of at our discretion without prior consultation with the client.


Payments

Payment details will be provided with your invoice.

Payment is due upon receipt of the invoice, or by the date specified on the invoice.

Eponine Patisserie Ltd reserves the right to terminate any agreements if authority for payment is refused at any stage.

We shall have the right to refuse or cancel any sale of a product which has been priced incorrectly due to a typographical error, or an error in pricing information from our suppliers.

By placing an order, you agree to indemnify us in full against all costs, fees, expenses and outgoings incurred by us in the process of obtaining payment. In the event of a failed or withheld payment, this will include an administrative cost (minimum £20).


Consultancy

Payment is required in full before commencement of any works.

We do not offer credit unless otherwise agreed. Any lines of credit offered will be at the discretion of Eponine Patisserie Ltd.

In the event of an invoice being issued after the commencement of works, payment is due upon receipt of invoice. Late payments may attract debt recovery costs and statutory interest.

Eponine Patisserie Ltd and its agents shall have the right to reclaim any additional or unforeseen business or personal expenses incurred during works partaken on behalf of a client, unless otherwise stated in the service agreement.
